Gebruiksvoorwaarden WorkSmart.ai
1. Wie wij zijn en waar deze voorwaarden voor gelden
De app Work Smart wordt aangeboden door [BEDRIJFSNAAM], [ADRES], KvK [KVK-NUMMER] (“WorkSmart”, “wij”). Door de app te installeren, een account aan te maken of de app te gebruiken, ga je akkoord met deze voorwaarden en met ons Privacybeleid. Download je de app via de Apple App Store, dan geldt daarnaast de standaard Licensed Application End User License Agreement van Apple; via Google Play gelden daarnaast de voorwaarden van Google Play.
2. Wat de app doet
Work Smart helpt bouwprofessionals met rekenhulpen (plafonds, wanden, tegels, verwarming enz.), het maken van offertes en facturen, het bijhouden van projecten, een AI-ondersteunde scanfunctie (“Scan & Spreek”), een overzicht van Nederlandse bouwnormen met links naar de officiële bronnen, en verwijzingen naar externe leveranciers en partnerbedrijven.
3. Account
- Voor het opslaan van projecten, facturen, scans en offertes heb je een account nodig (e-mailadres en wachtwoord). Je bent verantwoordelijk voor het geheimhouden van je wachtwoord en voor alles wat er met je account gebeurt.
- Je moet minimaal 16 jaar zijn en de app gebruiken voor beroeps- of bedrijfsdoeleinden.
- Je kunt je account op elk moment zelf verwijderen via Profiel & instellingen → Account verwijderen. Daarmee worden je servergegevens permanent verwijderd.
4. Jouw gegevens en jouw verantwoordelijkheid als ondernemer
Offertes en facturen die je met de app maakt, maak je op eigen naam en onder eigen verantwoordelijkheid. Jij bent verantwoordelijk voor de juistheid van bedragen, btw, bedrijfsgegevens, klantgegevens en voor het voldoen aan de wettelijke eisen voor facturen en administratie. Klantgegevens die je invoert, verwerk je als verwerkingsverantwoordelijke onder de AVG; die gegevens blijven op je toestel.
5. AI-functies
De scanfunctie stuurt foto’s en de tekst van je vraag via onze server naar een AI-dienst (zie het Privacybeleid). De uitkomst is een schatting die fouten kan bevatten. Upload geen foto’s van personen of van gegevens van derden die daar geen toestemming voor hebben gegeven. Gebruik de functie niet voor onrechtmatige doeleinden.
6. Externe partners, leveranciers en normen
Namen, prijsindicaties, websites en contactgegevens van leveranciers en partnerbedrijven zijn informatief. WorkSmart is geen partij bij overeenkomsten die je met hen sluit, verwerkt geen betalingen en ontvangt geen opdracht namens jou. Prijzen en beschikbaarheid zijn uitsluitend die van de betreffende partij. Links naar normen en wetgeving (NEN, Arbo, Bbl) verwijzen naar externe bronnen; de tekst van die bronnen is leidend.
7. Toegestaan gebruik
Je mag de app niet gebruiken om de wet te overtreden, om de dienst te verstoren, te reverse-engineeren of te kopiëren, om misbruik te maken van de AI-functies (bijvoorbeeld door geautomatiseerd of excessief gebruik), of om toegang te krijgen tot gegevens van anderen. Bij misbruik kunnen wij je account beperken of beëindigen.
8. Intellectueel eigendom
De app, de merken “Work Smart” en “WorkSmart.ai”, de vormgeving, teksten en software zijn eigendom van WorkSmart of haar licentiegevers. Je krijgt een persoonlijk, niet-overdraagbaar, niet-exclusief gebruiksrecht voor de duur van je gebruik. De inhoud die jij invoert (projecten, offertes, foto’s) blijft van jou; je geeft ons alleen het recht die te verwerken voor zover nodig om de app te laten werken.
9. Beschikbaarheid en wijzigingen
Wij spannen ons in om de app en de bijbehorende diensten beschikbaar te houden, maar garanderen geen ononderbroken werking. Wij mogen functies wijzigen, toevoegen of verwijderen en de app updaten. Sommige functies vereisen een internetverbinding.
10. Aansprakelijkheid
De app wordt geleverd “zoals hij is”. Voor zover de wet dat toestaat, is WorkSmart niet aansprakelijk voor schade die voortvloeit uit het gebruik van de app of uit beslissingen die je neemt op basis van berekeningen, prijsvergelijkingen, AI-analyses of partnerverwijzingen, waaronder gemiste omzet, verkeerde bestellingen of onjuiste offertes en facturen. Onze totale aansprakelijkheid is in ieder geval beperkt tot het bedrag dat je in de twaalf maanden vóór de schade voor de app hebt betaald (bij gratis gebruik: € 0). Deze beperking geldt niet bij opzet of bewuste roekeloosheid en laat dwingendrechtelijke consumentenbescherming onverlet.
11. Beëindiging
Je kunt op elk moment stoppen met de app en je account verwijderen. Wij mogen je toegang beëindigen bij schending van deze voorwaarden of als wij de dienst staken; in dat laatste geval informeren we je vooraf waar redelijkerwijs mogelijk.
12. Toepasselijk recht en geschillen
Op deze voorwaarden is Nederlands recht van toepassing. Geschillen worden voorgelegd aan de bevoegde rechter in het arrondissement waar WorkSmart gevestigd is, tenzij dwingend recht anders bepaalt.
13. Wijzigingen van deze voorwaarden
Wij kunnen deze voorwaarden wijzigen. Bij belangrijke wijzigingen informeren we je in de app of per e-mail. Blijf je de app na de wijziging gebruiken, dan ga je akkoord met de nieuwe voorwaarden. De actuele versie staat op worksmartai.nl/voorwaarden.

1. Who we are and scope
The Work Smart app is provided by [COMPANY NAME], [ADDRESS], KvK [KVK NUMBER] (“WorkSmart”, “we”). By installing the app, creating an account or using the app you agree to these terms and to our Privacy Policy. If you download the app from the Apple App Store, Apple’s standard Licensed Application End User License Agreement also applies; from Google Play, the Google Play terms also apply.
2. What the app does
Work Smart helps construction professionals with calculators (ceilings, walls, tiles, heating etc.), creating quotes and invoices, keeping track of projects, an AI-assisted scan feature (“Scan & Speak”), an overview of Dutch building standards with links to the official sources, and referrals to external suppliers and partner companies.
3. Account
- Saving projects, invoices, scans and quotes requires an account (e-mail address and password). You are responsible for keeping your password confidential and for everything that happens under your account.
- You must be at least 16 years old and use the app for professional or business purposes.
- You can delete your account at any time via Profile & settings → Delete account. This permanently deletes your server data.
4. Your data and your responsibility as a business
Quotes and invoices you create with the app are issued in your own name and under your own responsibility. You are responsible for the correctness of amounts, VAT, company and client details, and for complying with the legal requirements for invoices and bookkeeping. Client data you enter is processed by you as a controller under the GDPR; that data stays on your device.
5. AI features
The scan feature sends photos and the text of your question through our server to an AI service (see the Privacy Policy). The result is an estimate that may contain errors. Do not upload photos of people or of third-party data without their consent. Do not use the feature for unlawful purposes.
6. External partners, suppliers and standards
Names, price indications, websites and contact details of suppliers and partner companies are informational. WorkSmart is not a party to any agreement you conclude with them, processes no payments and places no orders on your behalf. Prices and availability are solely those of the respective party. Links to standards and legislation (NEN, Arbo, Bbl) refer to external sources; the text of those sources prevails.
7. Acceptable use
You may not use the app to break the law, disrupt the service, reverse-engineer or copy it, abuse the AI features (e.g. automated or excessive use), or access other people’s data. In case of abuse we may restrict or terminate your account.
8. Intellectual property
The app, the “Work Smart” and “WorkSmart.ai” marks, the design, texts and software are owned by WorkSmart or its licensors. You receive a personal, non-transferable, non-exclusive right to use the app for the duration of your use. The content you enter (projects, quotes, photos) remains yours; you only grant us the right to process it as needed to run the app.
9. Availability and changes
We make reasonable efforts to keep the app and related services available but do not guarantee uninterrupted operation. We may change, add or remove features and update the app. Some features require an internet connection.
10. Liability
The app is provided “as is”. To the extent permitted by law, WorkSmart is not liable for damage arising from the use of the app or from decisions you make based on calculations, price comparisons, AI analyses or partner referrals, including lost revenue, wrong orders or incorrect quotes and invoices. In any event our total liability is limited to the amount you paid for the app in the twelve months preceding the damage (for free use: € 0). This limitation does not apply in case of intent or deliberate recklessness and does not affect mandatory consumer protection.
11. Termination
You can stop using the app and delete your account at any time. We may terminate your access if you breach these terms or if we discontinue the service; in the latter case we inform you in advance where reasonably possible.
12. Governing law and disputes
These terms are governed by Dutch law. Disputes are submitted to the competent court of the district where WorkSmart is established, unless mandatory law provides otherwise.
13. Changes to these terms
We may change these terms. We inform you of material changes in the app or by e-mail. Continuing to use the app after a change means you accept the new terms. The current version is at worksmartai.nl/voorwaarden.
